比约纳尔·博维克教授自 2017 年起任教于挪威卑尔根大学法学院，2008 年获该校博士学位。其研究与教学领域为国家及欧洲人权法、个人数据保护（侧重欧盟《通用数据保护条例》框架）。博维克教授曾任教务副院长（2014–2017）；由挪威议会任命为隐私上诉委员会副主席（2017–2024，两届）；多次出任西挪威上诉法院上诉法官；现任挪威媒体投诉委员会主席（2019 年起）及挪威反歧视法庭主席（2022 年起）。
Professor Borvik served as Vice Dean for Education (2014–2017). He was appointed by the Norwegian Parliament as Vice Chair of the Norwegian Privacy Appeals Board for two terms (2017–2024), and has served as Appellate Judge at the Court of Appeals for Western Norway on several occasions. He is Chair of the Norwegian Media Complaints Commission (since 2019) and Chair of the Norwegian Anti-Discrimination Tribunal (since 2022).
讲座摘要
The Nordic countries are well known for having developed strong protection of civil and political human rights. These rights are protected by national constitutions. In addition, all the Nordic countries have incorporated the European Convention on Human Rights (1950) into their national legal systems. The European Court of Human Rights interprets and applies these legal norms, and the case law from the Court has played an increasingly important role in the development of human rights protection in the Nordic countries. This lecture will examine how the Court has considered various cases from Nordic countries dealing with freedom of expression and its balance with conflicting human rights, such as the right to privacy, reputation, and protection from hate speech.
北欧国家素以完善的公民及政治人权保护著称，相关权利由各国宪法保障。此外，北欧各国均已将《欧洲人权公约》（1950 年）纳入本国法律体系。欧洲人权法院负责解释和适用上述规范，其判例对北欧人权保护的发展影响日深。本次讲座将聚焦欧洲人权法院如何审理北欧国家涉及冲突性人权平衡案件，从法学角度探讨其中的平衡问题。
